Before you file internationally, you need a starting point. This is your Indian trademark application or registration. It's called your "basic mark." Think of it like your anchor. Your international application is tied to this base - at least for the first 5 years.
You can file in 130+ countries that are members of the Madrid Protocol. Each country you pick is called a designated country. You choose where you want protection - no need to apply everywhere. If a country isn't in the Madrid system (like some in South America or the Middle East), you'll need to file there separately through national filing.
Don't panic - rejection isn't the end. Every country has its own rules. Sometimes your mark may clash with something local, or a technicality might raise a flag. If that happens, you have two options:
That's the beauty of this system. One rejection doesn't kill your whole application. Your trademark stays protected where it's approved.
Your international trademark lasts for 10 years. After that, you can renew it every 10 years as many times as you need. One renewal covers all the countries in your registration — no need to renew each one separately.
No — and this is important. Each country reviews your trademark separately. They can approve it, raise objections, or reject it based on their local trademark laws. WIPO only manages the process — they don't give you rights in each country. That decision is up to each country's IP office.
If your Indian trademark (your basic mark) is refused or cancelled within 5 years, your international registration may also fall apart. This is called the "central attack." But there's a fix.
