What is the Madrid Protocol?

It's the shortcut to trademark protection around the world. Instead of filing in every country one by one, you file once, through your home country - and the Madrid Protocol takes it from there.

It's run by WIPO (World Intellectual Property Organization). They manage the process, forward your application, and keep it all connected under one global system. Think of it as a passport for your brand - valid in 130+ countries. One application. One process. One less headache.

Can I apply from India?

Yes - and it's easier than you think. If you're an Indian citizen, company, startup, or MSME - you're eligible. But here's the catch: You must already have (or be filing) a trademark application in India. That Indian application is your base. Without it, the international one can't move forward. Once that's done, you're clear to apply - and we'll help file it through India's IP Office, straight to WIPO.

What documents do I need?

Not a mountain - just a smart pile. Here's what usually goes in:

  • • Proof of identity (for individuals) or business registration (for companies)
  • • Address proof
  • • A copy of your Indian trademark certificate (or application)
  • • The MM2 form - that's the main international filing document
  • • A clear image or description of your mark
  • • List of goods and services (we'll help classify them right)

Who can file an international trademark application under the Madrid Protocol?

You can apply if you meet any one of these three conditions:

  • • You live in a Madrid Protocol member country
  • • You own a business that operates there
  • • You're a citizen of a member country

If you're in India, you're eligible - because India is a member of the Madrid Protocol.

What is a "basic application" or "basic registration"?

Before you file internationally, you need a starting point. This is your Indian trademark application or registration. It's called your "basic mark." Think of it like your anchor. Your international application is tied to this base - at least for the first 5 years.

What countries can I file in under the Madrid Protocol?

You can file in 130+ countries that are members of the Madrid Protocol. Each country you pick is called a designated country. You choose where you want protection - no need to apply everywhere. If a country isn't in the Madrid system (like some in South America or the Middle East), you'll need to file there separately through national filing.

What happens if I get rejected in one country?

Don't panic - rejection isn't the end. Every country has its own rules. Sometimes your mark may clash with something local, or a technicality might raise a flag. If that happens, you have two options:

  1. 1. Respond to the objection (with our help, of course)
  2. 2. Let it lapse in that country - while keeping protection in all the others

That's the beauty of this system. One rejection doesn't kill your whole application. Your trademark stays protected where it's approved.

What is the duration of protection of an international registration?

Your international trademark lasts for 10 years. After that, you can renew it every 10 years as many times as you need. One renewal covers all the countries in your registration — no need to renew each one separately.

Does registration under Madrid automatically grant protection in all countries?

No — and this is important. Each country reviews your trademark separately. They can approve it, raise objections, or reject it based on their local trademark laws. WIPO only manages the process — they don't give you rights in each country. That decision is up to each country's IP office.

What happens if my basic mark is refused or cancelled?

If your Indian trademark (your basic mark) is refused or cancelled within 5 years, your international registration may also fall apart. This is called the "central attack." But there's a fix.

You can file separate national applications in each country where your mark was accepted. This way, you keep your protection even if the base is lost.

Can I apply without a lawyer?

Technically? Yes. But should you? That's another story. International filing is full of small traps: Wrong classification, missing countries, misfiled fees - even a typo can cost you protection. Thus, WIPO strongly recommends that you hire an experienced IP lawyer. A lawyer knows the system inside out - and can save you from long delays, rejections, or central attack risks.

Think of it like hiring a guide to climb Everest. You can try it solo…but why take the risk?

How long does the process take?

From filing to final approvals? It's a journey. Here's the breakdown:

  • • WIPO Review: 1–2 months
  • • Country Reviews: Up to 18 months, depending on the country
  • • Objections or oppositions? That may extend things a bit more

Some countries approve faster (like the UK or Australia). Others take their time. But the average timeline is 6 to 18 months. The good part? Once approved, your protection lasts 10 years and covers all designated countries.
